Terms of Service (MissyLeads)

These Terms of Service (“Terms”) govern your access to and use of MissyLeads (the “Service”), provided by Mural & Pixel Graphics LLC (DBA “MissyLeads”) (“MissyLeads,” “we,” “us,” or “our”).
By creating an account, subscribing, or using the Service, you agree to these Terms.
1) Definitions
- “Customer” means the business entity or individual using the Service (e.g., a plumbing company).
- “End User” means a caller/texter who contacts a Customer through a MissyLeads-enabled number.
- “Content” means voicemails, call recordings (if enabled), SMS/MMS messages, photos, transcripts, and related data.
2) The Service
MissyLeads provides tools that may include:
- Call routing/forwarding to Customer phone numbers
- Voicemail capture and delivery (including links/notifications)
- Messaging workflows (e.g., customer-care follow-up texts)
- Lead summaries and basic inbox/management features
The Service may rely on third-party networks and providers. Delivery and uptime are not guaranteed.
3) Eligibility and Account Responsibilities
You must be able to form a binding contract and use the Service for legitimate business purposes. You agree to:
- Provide accurate account and business information
- Maintain the security of your credentials
- Ensure your routing rules, voicemail greetings, and workflows are appropriate for your customers
4) Free Trials, Subscriptions, and Billing
We may offer a free trial period. Trial terms (duration, features, and any conversion rules) will be presented before or during activation.
Unless otherwise stated:
- Subscriptions are billed monthly in advance.
- Fees are non-refundable except where required by law.
- We may suspend or terminate access for non-payment.
- We may change pricing with notice. Continued use after the effective date constitutes acceptance of the new pricing.
5) Acceptable Use
You agree not to use the Service to:
- Send spam, scams, or deceptive communications
- Send marketing/promotional texts without required consent
- Harass, threaten, or abuse any person
- Violate any law, regulation, or third-party rights
- Attempt to interfere with the Service or bypass controls (including opt-out mechanisms)
We may suspend or terminate accounts for violations, excessive complaints, or carrier filtering issues.
6) SMS/MMS Messaging, Consent, and Opt-Out
If you enable SMS/MMS through the Service:
- You are responsible for obtaining any required permissions/consents under applicable law (including TCPA and state laws), especially for any messages beyond purely transactional/customer-care purposes.
- You must honor opt-out requests. End Users can generally opt out by replying STOP and request help by replying HELP.
- Message frequency varies; message and data rates may apply.
- Carriers may block or filter messages; we do not guarantee delivery.

7) Call Recording and Voicemail
Depending on configuration, the Service may record voicemails and may also support call recording features.
You are solely responsible for complying with all applicable call recording and consent laws (including any “two-party consent” requirements). If you enable call recording, you agree to provide any required disclosures and obtain any required consent.
8) Content, Ownership, and License
As between you and MissyLeads:
- You (and/or your End Users) retain rights in your Content.
- You grant MissyLeads a limited license to host, transmit, store, process, and display Content solely to provide and improve the Service, prevent abuse, and comply with law.
- You represent you have the rights needed to provide Content to the Service.
9) Third-Party Services
The Service may integrate with or depend on third-party providers (communications, hosting, analytics, payment processing). Your use of those services may be subject to their terms. We are not responsible for third-party outages or failures.
10) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will increase revenue, capture all missed calls, or that voicemails/texts will always be delivered.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- MISSYLEADS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO MISSYLEADS FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Indemnification
You agree to defend, indemnify, and hold harmless MissyLeads from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service,
- Your Content,
- Your communications with End Users,
- Your violation of law (including messaging/consent/call recording laws), or
- Your violation of these Terms.
13) Termination
You may cancel at any time (billing terms still apply through the current period). We may suspend or terminate your access if:
- You breach these Terms,
- You create significant legal/compliance risk,
- We are required to do so by a provider or law, or
- Your account is delinquent.
Upon termination, your access ends. We may retain or delete data consistent with our Privacy Policy.
14) Governing Law and Venue
These Terms are governed by the laws of California, without regard to conflict of laws principles. Any dispute will be brought in state or federal courts located in California, and you consent to personal jurisdiction there.
15) Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new “Last Updated” date. Continued use after changes become effective constitutes acceptance.
